Residential Real Estate Transaction Conveyancing Services & Escrow Services
Escrow Services:
We act as a third-party Agent holding funds for a transaction until all conditions are met, protecting both the buyer and seller regarding large-scale logistic transactions that involve $50,000 plus shipments.
Limited Scope Services to Private Mortgage Equity Lenders:
Process and prepare mortgages, refinancing and supplemental documents and report in a timely manner.
Services for Real Estate Lawyers:
Alternative to in-house conveyancers, our support services are entirely virtual.
Private Mortgage Equity Lenders:
Assist with any of the following;
Prepare residential real estate files from opening to closing
Process and prepare mortgages, refinancing and supplemental documents and report in a timely manner.
Liaise with Mortgage Brokers, financial institutions, clients, and other law firms regarding all aspects of facilitating the closing
To assist with transactions on behalf of the Lender as duly authorized agent and representative;
Deduct all fees from our trust account and send the remaining proceeds to the Borrower's lawyer;
Draft mortgage instructions to send to borrower's Lawyer;
On instructions of the Lender, prepare various security documents;
To ensure submitted documents meet all legislative requirements for registration;
Title, Tax search, confirm mortgage balance;
General due diligence;
Attendance on the execution of documents;
Attendance at land titles for registration
Receiving and Disbursing Funds from our insured Trust Account:
We will receive funds from you or the Lender into our Trust Account. We will also disburse funds to payees.
Working with other Parties involved in your Transaction:
A real estate transaction often requires interaction with several parties who are involved in the transaction in one way or another. Therefore, we coordinate on all matters relating to your transaction as required between you, your real estate agent, mortgage broker, mortgage lender, insurer, Land Titles office, municipality, surveyors, couriers, and other people involved in a real estate transaction.
Transfer of Title:
To add or remove a person from the title, you do so by transferring the title from the old owner(s) to the new owner(s)
Other Property Acquisition or Lending Services:
In addition to those specific matters set out above, CSA can assist you with other matters you may be involved in relating to buying or selling an interest in a property or using a property as security for lending or borrowing.
Conveyancing Services Alberta Corp. ("CSA") is a legally and fully insured Real Estate Transactional Conveyancing Services Provider.
What is a real estate transaction service provider?
It is authorized by the private mortgage equity lender and borrower to act as Agent and Representative and is responsible for facilitating the closing process in a real estate transaction.
They ensure that all the various documents are prepared and executed appropriately, registered at the land titles office, and funds are collected and disbursed to all proper parties.
What is the difference between real estate transaction service providers? And a Real Estate Lawyer?
They both play crucial roles in real estate transactions, but their functions and responsibilities differ significantly.
The primary distinction between the two is that a Real Estate Lawyer is a licensed legal professional.
A real estate transactional conveyancing services provider is a firm with "specialized expertise" in the closing process of a real estate transaction and maintains specific professional liability insurance coverage to conduct business in the manner that it does.
Engaging a Real Estate Lawyer can be more necessary in complex transactions while using a Real Estate Transactional Conveyancing Services Provider is more suitable for straightforward deals or professional real estate investors.
CSA maintains and utilizes a separate Trust account for all conveyancing transactions, which is governed and regulated both by the laws of the Province of Alberta dealing with conveyancing and the maintenance and use of Trust accounts and related facilities, as well as our insurer’s conditions for all necessary insurance coverage to remain in force and effect.
Services that CSA Cannot Provide:
CSA cannot provide any services that would be considered as “legal services” and which it is not permitted in law to provide to or on your behalf;
CSA cannot provide any advice that would be considered as “legal advice” which it is not permitted in law to provide to you or on your behalf;
Notwithstanding the foregoing, If you request legal services or legal advice from CSA or its representatives, which we are not legally authorized to provide to you, CSA will make all best efforts, on an expedited and cost-effective basis, to assist you in obtaining such legal services or legal advice.
